Terms of Service

These Terms govern your access to and use of the DermaPrime website and application (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, and our Medical Disclaimer.

1. Eligibility

You must be 16 or older and able to enter into a binding contract.

2. Nature of the Service

DermaPrime is an informational and educational AI tool for skin imaging analysis and longitudinal monitoring. It is not a medical device cleared for diagnosis. CE and FDA pathways are in progress. The Service is not a substitute for professional medical advice, diagnosis, or treatment.

3. Your account

• Keep your credentials secure; you are responsible for activity on your account.
• Provide accurate information and keep it updated.
• One account per person, unless otherwise agreed.

4. Acceptable use

You agree not to:

• Upload images of other people without their consent.
• Reverse engineer, scrape, or attack the Service.
• Use the Service to provide medical care to third parties unless you are a licensed clinician using the clinician tools we provide.
• Submit unlawful, harmful, or infringing content.

5. Paid features

Subscriptions and one-off purchases (such as clinician reviews) are billed through our payment processor. Pricing is shown in EUR for users in the EU and USD elsewhere; taxes may apply. Cancellations take effect at the end of the current billing period unless mandatory law provides otherwise. EU consumers can withdraw from a purchase of digital content within 14 days unless they expressly agreed to immediate performance and acknowledged the loss of the withdrawal right, which we ask for before delivering instant analyses or clinician reviews.

6. Intellectual property

We retain all rights in the Service. You retain ownership of the images and notes you submit and grant us a limited, revocable license to process them solely to provide the Service. We use your data to improve our models only if you opt in.

7. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties. Nothing limits liability that cannot be limited by law, including liability for death, personal injury caused by negligence, or fraud.

8. Liability

To the extent permitted by law, our aggregate liability under these Terms is limited to the greater of (a) amounts you paid in the 12 months before the event giving rise to liability or (b) EUR 100.

9. Termination

You may delete your account at any time from Account → Privacy. We may suspend or terminate access for breach of these Terms or to comply with law.

10. Governing law

These Terms are governed by the laws of the European Union member state in which DermaPrime is established, without prejudice to mandatory consumer protection rules of your residence.
